Florida lawmakers pass law aimed at crippling ADA lawsuit abuse

I agree that it is high time Florida do something about the PLETHORA of ADA lawsuits that go on over there. I like the idea of the bill. I like the concept. However the bill isn't any good if it gets signed. Did you see who counts as a "qualified" expert? An engineer? A landscape...

    Emergency Showers & Eyewashes

Electrical installations in buildings would fall under NEC. You could submit a proposal for the 2020, if you believe that what is being described in the original post a hazard. Public input is open right now, until later this year.

    Emergency Showers & Eyewashes

OP said "near" eyewash station. This is a dry location and all one has to do is go into NEC definitions. Location, Dry. A location NOT NORMALLY subject to dampness or wetness. A location classified as dry may be temporarily subject to dampness or wetness, as in the case of a building under...

    Emergency Showers & Eyewashes

It's not considered a wet location per NEC.

    ANSI A117.1-2003 vs. 2009

If you understood safe harbor, you would understand my comment.

    ANSI A117.1-2003 vs. 2009

As does not knowing which specific state you are talking about. If you are trying to find one "primary" set of rules to build with that can be used applicable to any state - good luck with that. Many of the adopted codes by each state provide something unseen - and nebulous - known as "safe...

Parking sign too low? See you in court!

I do like and enjoy the ADA, though. I don't take it as political. I won't get into my personal details, but I know what it is like not to be able to walk...or to have to look for the nearest bench because I don't know at what point in time I might just collapse. Can't go further than that (I...

    Solar and Bond Bushings?

A solar installation is generally not a separately derived system unless there is no direct connection. See definition of "separately derived system."

    Motor Disconnect Location

To me, it didn't look like it was in front. It looks like it is recessed somehow, under the equipment.

Parking sign too low? See you in court!

Plumbing fixtures such as urinals and grab bars are different from signs, but I understand your point. Some ADA elements have absolute measurements, and some have a specified range of measurements. Tolerances are not applicable when there is a specified range of measurements, as the tolerances...

Parking sign too low? See you in court!

I'm not sure what the hangup is with Einstein, or what you are trying to prove by making it a mission to prove me wrong. But I think it has done quite the opposite. My comments are vaild, as is my point. I will stand by what I said.

Parking sign too low? See you in court!

That technical assistance guy isn't a member of the board. He's some technical assistance guy that works there. He would first have to understand my point in order to correctly interpret and answer the point that I made. I understand it is just easier to point to the guideline, and get you...

    I am aware of that.

Parking sign too low? See you in court!

It could be a local ordinance, or it could be state law. It is not ADA. In Florida (for instance) it is statute. So Florida statute and ADA come together: "The space must be posted with a permanent above-grade sign of a color and design approved by the Department of Transportation, which is...

Parking sign too low? See you in court!

Thanks but I'm not sure everybody understands my position. Just to be clear, I'm not saying that 60-inches is incorrect - "to the bottom of the sign" like everyone says. I'm just saying that in reality 59-inches could be correct, since the actual sign would be the lettering (provided the...

    You're missing the concept entirely.

OK. If they don't agree with me, then let me know who it is so I can call them and straighten this whole thing out.

Also the table on character height (703.5.5) seems to support my conclusion. See column header "Height to Finish Floor or Ground From Baseline of Character." PS - Rick I think you are pulling from the 91, we are now on the 2010

Parking sign too low? See you in court!

It is the same concept as the visual alarm, or even tactile. Look up tactile and they even spell it out in that code. Think about it for a minute - if you have a very large "border" with no information, that regulates the requirement? Or is it the conveyance of the information what is really...

Parking sign too low? See you in court!

Correct, the "sign" being the message (wording).

Parking sign too low? See you in court!

You are welcome. It came from the Access Board but I researched it a while ago, I don't know where it is posted. But it is posted somewhere (not much help). Visual alarms are funny this way as well. I'd probably be remiss if I did not bring it up. Access board determined that the entire...

Parking sign too low? See you in court!

It depends. A sign conveys information. The access board has determined that the "sign" isn't the physical metal, but the wording itself. So, if the metal of the sign was at 59-inches but the wording was at 60-inches, then it complies.

Existing elec panel in 1964 Apt. HVAC closet

Yes. And the only thing that some people have trouble grasping is that the 30-inches doesn't have to be "centered" on the equipment. I use the narrative of a "big box" that is 30-inches wide and 3-foot deep (and 6.5 feet high)! That box must be able to fit in the space that is anywhere in...
