EMERGENCY CHANGES TO BUILDING CODE TAKES EFFECT AUGUST 1, 2012
California Title 24, Part 2 to be modified to align with new ADA standards
Emergency Regulations have been approved by unanimous decision by the California Building Standards Commission on July 19, 2012. This emergency measure immediately revises the CBC to better align the codes with the 2010 ADA Standards, which took effect on March 15, 2012.
The adoption of these regulations is necessary for the immediate preservation of the public peace, health and safety and general welfare.
Conflicts existed between state and federal access codes which could not be resolved by using the more stringent of the two requirements. The codes could not be followed without resulting in a violation of the ADA, which also becomes a violation of California Civil Code.
These conflicts prevent public and private building owners from constructing new facilities or altering existing facilities in full compliance with the federal accessibility regulations. The conflicts also subject properties to technical violations which could result in lawsuits.
The Division of the State Architect took input and comments from accessibility stakeholders, interested parties and the general public through a series of Access Code Forums held in May, June and July of 2012.
The Emergency Regulations will resolve these irreconcilable conflicts, correct the language errors, eliminate uncertainty about the accessibility requirements and increase compliance with both state and federal regulations.
The Emergency Regulations will be in effect until they are superseded by the 2013 California Building Code on January 1, 2014.The California Building Standards Commission proposes to adopt these emergency building standards under the authority granted by Health and Safety Code Sections 18930 and 18949.1. Any responsibilities of the State Architect to adopt regulations relating to building standards are transferred to the California Building Standards Commission per Health and Safety Code Section 18949. The purpose of these building standards is to implement, interpret, and make specific the provisions Government Code Sections 4450 through 4461, 12955.1 and 14679; Health and Safety Code Section 18949.1 and 19952 through 19959. The Division of the State Architect is proposing this regulatory action based on Government Code Section 4450.
