Change of Code

The adopted codes for my question are the I-Codes 2009

This project is a single family home with a valid C of O under the IRC
It has been sold and is now applying to convert this to a B Occupancy under the IBC

Not sure how to apply a change in code from IRC to IBC
Would this be considered to be a “Change of Occupancy” from R3 to B, or would the structure be treated as new construction?
 
Might check to see if the municipality's zoning code allows you to go from a Residential Zoned District to a Business Zoned District?

One is change of Zoning Class
The other is change in Occupancy Class

It is common to see a residential structure turned into a business, but usually after theres been a zoning change of the property.

The real question is: Since this was previously valid under the IRC, does the IEBC consider a single family home an R3?
There needs to be a basis from what it was to what it will be, in order to determine levels of hazard under IEBC 2009: 912.4, 912.5 and 912.6

Accessibility would need to be addressed under IEBC 2009: 912.8

Personal code says it should meet IBC,

The intent is to use the structure as strictly office space for a construction company.
It is a single story ranch with a basement, each level is 1200 sf.

Yes; or instead use the prescriptive method; Sections 307 & 310.4
 
From a fire safety standpoint, the change form sleeping rooms to office is probably a safer use.
From a structural load standpoint, the office function is probably 25% more live load, and it would not surprise me if the building official requires calculations to justify the new loads on the existing framing.

Structural and accessibility are huge on this and IECC cannot be overlooked as if the structure is going to use any more energy, then the entire building needs to meet new code. C101.4.4
 
The purpose of the IEBC is to allow older buildings to be altered or changed in occupancy without requiring them to meet all the new construction requirements. If you had to tear an existing building down and build a new one to meet new energy requirements that would waste more energy in demolition, material production, delivery, etc., than a building meeting the energy code would save.
 
2012 IECC......C101.4.4 Change in occupancy or use. Spaces undergoing
a change in occupancy that would result in an increase
in demand for either fossil fuel or electrical energy shall
comply with this code.
Where the use in a space changes
from one use in Table C405.5.2(1) or (2) to another use in
Table C405.5.2(1) or (2), the installed lighting wattage
shall comply with Section C405.5.
C101.4.5 Change in space conditioning. Any nonconditioned
space that is altered to become conditioned space
shall be required to be brought into full compliance with
this code.
