I have a dive shop that provides training in a local pool they rent in the evenings. That pool is not in my AHJ. The shop when altered complied with all ADA requirements and has been in operation for several years. The owner just made a request regarding adding a small above ground pool in the rear of the property. The appears to meet all code requirements as far as a pool and electric, fencing etc.

The questions was raised would the pool need to meet ADA?

The pool will be offered in the summer months to clients. The other facility is still to be use as well. yet it is off site.

The owners reasoning is to provide a cheaper beginner training area at a much lower cost. One or two people at a time.

I believe it would need to meet ADA. Your thoughts please.
 
Why yes it would - an old rule of thumb that I used (and it kept me out of trouble) Private means 1, common means 2 or more ---- If it is private, it may be adaptable

If it is public or common, it has to be accessible.

Not written in any rule book that I am aware of, but it follows the history of case law as presented on DOJ website.......
 
Thanks for the support! This camper will be unhappy, but it isn't the first one! The off site pool is owned by a school and is rented. Builder bob: that is a good common sense rule of thumb.
 
Brudgers rule of thumb:

If it ain't a dwelling unit or a place of worship, it needs to meet ADA.

Even if it is one or the other, odds are it still needs to be accessible.
