Type IIB Construction High Rise Wall Framing

How many of you find this to be a code violation? This is a Type IIB building (high-rise) undergoing a Level 2 renovation of a condo unit.

what does the section concerning fur-out construction state? see 803.1.3 for starts - I don't think FRTW is required if these provisions are followed which is specific to the application and does not follow the general rules for combustible materials in 603 see item #18.
