What zoning code is used to issue permits in a PD after the PD has been established?

Is there a general rule governing what happens if the documents are lost? Where would I find out what happens if the documents are lost? The city sent an email saying that R2 zoning prevailed but are now saying that it doesn't to defend the issuance of the permit.

What zoning code is used to issue permits in a PD after the PD has been established?

Unfortunately, I am at my last shot at this...this will be my last chance to get a reconsideration without going up through the courts (I already spent a lot of money on the last appeal before the city changed the permit number making my suit against the city moot) and I am reaching my...

What zoning code is used to issue permits in a PD after the PD has been established?

It seems to me that it would be a ridiculous situation to allow people to build until 40% of the original plat is covered and then say that no one else can build anything from that time forward. I have searched for other permits but it looks like everyone else built without permits so Provo City...

What zoning code is used to issue permits in a PD after the PD has been established?

Yes - that's it. I'm assuming there is a general rule for PD's as to how the underlying zone works with the overlay PD after the PD has been approved. This would seem to be a standard rule for all PD's as clearly no one knows what to do.

What zoning code is used to issue permits in a PD after the PD has been established?

Ha! I didn't realize you were quoting me. I got that info from the city when they said they'd "lost" the original documents and they said if there were no documents that R2 zoning prevailed. They are arguing that the lot line is the periphery of the community.

What zoning code is used to issue permits in a PD after the PD has been established?

That is exactly what I argued but the city argued that this only applies to sub-divided lots that abut parcels of land outwith the development. They are saying the entire development is still treated as one entity. That's why I need something that says that after the PD is approved any additions...

What zoning code is used to issue permits in a PD after the PD has been established?

My house is in an R2PD zone - from my understanding this means that the PD is established and approved by the city. After this approval any additional structures are limited by the underlying zone (in this case R2) but I can't find where it specifically says this. The City are arguing that the...

What zoning code is used to issue permits in a PD after the PD has been established?

Would this be on the right track? All of Georgetown on the Park Amd. Phase I, according to the official plat thereof, on file in the office of the Utah County Recorder at Doc/Entry No. 36831-1984. Including Parcel Numbers 40:103:0001 through 40:103:0017

What zoning code is used to issue permits in a PD after the PD has been established?

I have contacted the developer to see if he knows. Do you know what the document would be called or what it would look like?

What zoning code is used to issue permits in a PD after the PD has been established?

I am not sure that the city ever provided me with a copy of the original PD documents as they said they were "lost". I'm going to go through all the files again and see if I have anything that contains it. I wish I could access documents online but the city is not very organized. If you have...

What zoning code is used to issue permits in a PD after the PD has been established?

Hi there! It's good to "see" you again - I've missed my friends from this forum. I may teach math but I have a lot to learn about building and land use so all the expert (and non expert advice is much appreciated) This is still the "deck issue" which I got another shot at because the original...

What zoning code is used to issue permits in a PD after the PD has been established?

Hi All, I am wondering if anyone can help me as a non expert member of the public. I live in a town home at the Georgetown on the Park PD, in Provo, Utah which is in an R2PD zone. I believe this means that after the PD was established the zoning used to determine the building of new structures...

What happens if a city approves a deck that seems to violate fire codes

I will have to look into that - so far I've only found attorneys who defend HOA's but you're right - there must be some who go after the rogue boards.

What happens if a city approves a deck that seems to violate fire codes

The last permit expired and he got nailed on it because I held their feet to the fire. This, the Certificate of non-compliance!! He tried to get around that by hiding the new deck in a secret folder in the "French Door" permit so because another administrative decision was made on the deck I was...

What happens if a city approves a deck that seems to violate fire codes

I open to all suggestions AND if anyone knows who investigates corrupt HOA's I'd be interested in that too :)

What happens if a city approves a deck that seems to violate fire codes

I just laughed at him and said that a former Senator should not be blackmailing neighbors - and of course he sent me personal pictures way back before this started - not too bad but definitely inappropriate - so he really doesn't have a leg to stand on!

What happens if a city approves a deck that seems to violate fire codes

I really appreciate the support! I know that he's been getting inside help as there is no way anyone would have though to hide the "new deck" in a French door permit AND then it failed inspection. I'm hoping this goes all the way!

What happens if a city approves a deck that seems to violate fire codes

The floodlights are for "security"! I think some bagpipe music might help too :) I'd better not or Karma will bite me in the butt!

What happens if a city approves a deck that seems to violate fire codes

The local city officials issued a second permit with the same (plus some additional ones) violations as the first. They are going to argue that the development was built on one lot because that's the only way they could permit it - and even then it's a stretch. Fortunately, because of my...

What happens if a city approves a deck that seems to violate fire codes

I agree Glenn - they should. And I would not have objected to him having a deck at all (even though it broke zoning) if he had kept away from the property line. Now I have that ugly 12 foot wall to look at and he's planning to make the top half white vinyl. No peace or light for me!

What happens if a city approves a deck that seems to violate fire codes

The folk on the other side of them are his buddies and are doing some illegal building of their own. Some of the commenters on my FB post are actually neighbors and I have received emails of support. The big question they are asking is how this ever got past the HOA - I know the answer to...

What happens if a city approves a deck that seems to violate fire codes

I've already put the brightest "security lights" I could find up!! According to the plans that were submitted the second time the property line is about 4 feet inside my living room - definitely need security!

What happens if a city approves a deck that seems to violate fire codes

Well - things have taken a turn (after $38,000 in legal bills). I had a certificate of non compliance attached to the previous structure as I knew the city were basically making me fight timeliness and then when I won they would say the structure didn't exist. So, next thing I know - Jeff Flake...
