NEW ORLEANS – A disabled man from Jefferson Parish is suing the owner of a Harvey shopping plaza, alleging he has difficulty accessing the facility with his grandchildren.

Lawrence Fultz filed a lawsuit March 22 in U.S. District Court for the Eastern District of Louisiana against Montavicz LLC, alleging violations of the American with Disabilities Act (ADA).

According to the complaint, Fultz is a wheelchair-bound citizen with disability under the ADA who frequently visits Saulet Plaza, a property owned by defendant at 4001 Lapalco Blvd.

The suit says in the shopping center is Kids Dental Zone dental office to which Fultz regularly takes his grandchildren. The plaintiff alleges there are certain mobility barriers that make it difficult for him to access the property, including accessible-designated parking spaces not marked with vertical signage, two curb ramps taht lead directly into the pathway of vehicles, no accessible route near Saulet Plaza, an impermissible ramp in front of the Kids Dental Zone, the service counter in Kids Dental Zone being excessively high and other mobility-related obstructions.

The plaintiff alleges these barriers will make future visits difficult, and that fixing these barriers are readily feasible and easily accomplished.

Fultz asks the court to issue an order for the defendant to fix the property, plus reasonable attorney fees, the cost of the suit and any related expenses and relief deemed proper by the court. He is represented by attorneys Andrew D. Bizer, Garret S. DeReus and Amanda K. Klevorn of The Bizer Law Firm in New Orleans.
