2x2 emergency light with battery backup

I have office tenant space inside portion of building with 2x2 lights that have battery backup. Their is two feeds to the lights one switch and another unswitched. The switched portion allows the 2x2 emergency light fixture to turn off light. However when the electric power goes off or fails then the unswitchted portion kicks in regardless of light switch is on or off.

Question:

1. Does not the 2x2 emergency light fixture need to stay on and Not be switched all the time? What does IBC 2018 say about this?

2. Is their any requirement of night light for such space in IBC 2018 or not?
