So if say an apartment complex lets a private group do after school Supervision of children K-6 grade, for two hours, five days a week::::


Are they a day care and have to follow all the code requirements???

Need more info... If this is some Mom watching everyone's kids after school until their parents get home, and she's not req'd. to be licensed for that by your state, then no, I wouldn't touch it. I most likely wouldn't even hear about it.

If it's a for-profit group running it as a business, or if this is a listed use on the drawings for a new/remodeled bldg., then yes.

From the 2015 Handbook in reference to Goup B occupancy (occupant load of less than 50):

Although it is specified that there are no occupant age criteria associated with classification as Group B occupancy, it may be necessary to apply a higher level classification where the hazards anticipated based on the specific use fall outside of those typically encountered within Group B occupancy. For example, skill development activities conducted for infants or toddlers should more appropriately be considered as a Group E or I-4 occupancy if the potential hazard level is consistent with that of a day-care facility.

Have to look at handbook

Base code does not seem to indicate a B
 
Seems like in the old days pre I Code, there use to be so many hours so many days,

Before it was considered a day care.


So another example is the gym child care areas,seems like these fall under day care??
 
The applicable code is the IEBC or Chapter 34 (Existing Building) for a partial change of occupancy. A quick look at the change to an E from R has an equal Means of Egress Hazard Category, a lower Heights and Areas Hazard Category and the same Exposure of Exterior Walls Hazard Categories.
