Almost a covered mall?

Not where I really want to be
I have a large mercantile store that is proposing having a wine shop that is accessible from the exterior and from the interior main store. Now they have proposed an ice-cream, snack area that is only accessible from the interior of their store but they are contemplating leasing this space out too. Now that I have 2 "tenant" spaces would this move it to the covered mall section of 402?

Not if the building totally complies with other applicable provisions of this code. 402.1 exp. 2

Looks like any other department store or Wallmart with the "independent" eye doc, the McDonalds in the back etc.

It is not a mall.

There were recent code changes offered to make it more clear that this is allowed. Look at 1014.2.1 in the 2009 IBC for clarification. A single space with multiple tenants is acceptable as long as you can still have a configuration where people can exist when one place is closed for the day.

Sounds like you have a building similar to a Walmart where there are sub tenants within the building envelope.

A mall, on the other hand, specifically refers to the pedestrian part of a covered mall and not the tenant spaces
