Area if Refuge Existing Change of Occupancy to R-2 & Mixed

I have an old abandoned factory that is being converted into R2 apartments with an office area, a basement accessible by elevator with storage units (for tenants) and mechanicals and some common areas, including a meeting room on several of the floors (4 story building).

We asked for designation of Areas of Refuge during plan review and the response was that IBC 1007.3 Exception #7 applies for an R2, therefore AoR does not apply.

Thoughts?
 
Exception 3 would apply also since an R-2 is required to be sprinklered. The safest place for a disabled residence would be their individual unit since it also has some prescriptive fire protection built in and wait there for the assistance they may need.
 
As long as the R-2 portion of the building (including stairways, exits, etc)is separated with a fire wall, I'd be ok with that argument. But I doubt it is.
 
Assuming you are using 2009 IBC...Exception 7 works assuming it's sprinklered...

I would need a bit more information to make an informed comment. I am also assuming this is using the 2009 IBC? 2006 IBC, 1007.1 & 1007.3, exceptions end at 3 & 5 respectively. This may be consistent with 3406.1 & 3406.3, Change of Occupancy & Stairways conformance requirements.

Just read the IBC 2009...nevermind my questions if 2009. Big change in philosophy. Not sure I understand how 903.2.8 & Table 1016.1 mesh up, but I guess I will sleep tonite in my non-sprinklered R occupancy with 225' of travel distance.
 
1007.1 exception 1. Accessible means of egress are not required in alterations to existing buildings. But 3411.4.2 says if it is a complete change of occupancy it does only need an accessible route to the primary function area but not a accessible means of egress (where the area of refuge comes in).

That is what I have read also Rick.....I don't like it....like a roach motel......they can get in but not out.....?
