Bolted connection to type 1 fan

First time I've run across a side inlet utility fan for a type 1 kitchen hood. Supplier and mechanical contractor are telling me there is no way to bolt this connection per 506.3.2.3 (2009 IMC) - anyone have experience with this connection?

506.3.2.3 Duct-to-exhaust fan connections. Duct-to-exhaust fan connections shall be flanged and gasketed at the base of the fan for vertical discharge fans; shall be flanged, gasketed and bolted to the inlet of the fan for side-inlet utility fans; and shall be flanged, gasketed and bolted to the inlet and outlet of the fan for in-line fans.

The manufacturer should be able to supply cut sheets and installation guides for the fan. A hinged upblast fan is probably less expensive and will be easier to maintain.
