Broken Locking mechanism on exterior service panel

Would a broken locking mechanism on an exterior service panel cover be a violation of the NEC if it did not affect the closing of a panel in a location other than a dwelling unit?

What say thee?

Locking? Or latching? I would guess that maybe the latching is a condition of listing, but maybe not locking.......

The panel is manufactured, listed and labeled to be locked and the device does both, lock and latch.

A new listed product has got to be identical to the way it was when it left the factory. If the lock is broken, so is the listing. If it is existing, it shall be maintained in compliance with it’s listing.
