Broken Locking mechanism on exterior service panel

Would a broken locking mechanism on an exterior service panel cover be a violation of the NEC if it did not affect the closing of a panel in a location other than a dwelling unit?

What say thee?
 
A new listed product has got to be identical to the way it was when it left the factory. If the lock is broken, so is the listing. If it is existing, it shall be maintained in compliance with it’s listing.
