Bus shelters

Do local AHJ's require building permits for things like bus shelters on a public sidewalk? What if in a public right-of-way?
 
We designed bus shelters for a local municipality.
There was not a building department plan check, because it was too small of a structure (under 120 SF - - see CBC 105.2). However, we did provide full architectural plans and structural calculations, for Public Works to review and approve as the owner of the project.
 
So PW is who I thought should be handling this, but this AHJ has sent them to me. I will clarify this with them.

Somebody should, but I think it is PW. I only see two accessibility requirements for bus shelters in the ANSI standard: W/C space and accessible route. The IBC prohibits encroachments into the right-of-way (ch. 32), which I take as not covered by the IBC. But, I have never been asked before, so I'm not sure. I queried the CBO, we'll see what he says. FWIW, the applicant is the city.
 
Steer as far away from anything to do with these as you can. You will not have the wherewithal to get compliance since you will be dealing with another government department who will be doing the work.

U.S. Department of Transportation ADA requirements related to public transportation services, including bus stops and stations, are the minimum standards that must be met to comply with federal law.
 
Depending on the street you may also need a placement permit from D.O.T on your state Hwy. We do here with anything dealing with state roads.
 
ROW no...private property, yes....unless you can get it under 200ft....

Building:
1. One-story detached accessory structures used as tool and storage sheds, playhouses
and similar uses, provided the floor area is not greater than 200 square feet (18.58 m²).
 
I am doing my best to keep clear. They are under 120sf², I have asked and am waiting on an answer.
