Damp Locations... ?

In the picture, there is a NM wire run to the tankless, gas water heater on anexterior wall and outside of the conditioned building envelope. This is a SFR/SFH. Is the NM wire a compliant install? Is inside the appliance cabinet a ' damp 'location or not? Why or why not? Code sections please! What say ye?

Provided that the cabinet is listed for the location, I would say that the NM cable is not in a damp location. If we were to consider that a damp location than would not a NEMA 3R meter/panel combo be a damp location and NM prohibited from being installed?

NEC 300.9 & IRC section E3802.7 would not apply as those section only deal with raceways in wet locations and not enclosures.
