Definition of Retaining Wall

no definition, my take if you remove the wall and the dirt sloth past the base of the wall it is a retaining wall

From the 2018 IRC, Ch. 2 - Definitions: "Wall, Retaining - A wall not laterally
supported at the top, that resists lateral soil load and other imposed loads".

The 2021 Oregon Residential Code has a definition for retaining walls.

"WALL, RETAINING. A wall not laterally supported at the top, that resists lateral soil and other imposed loads."

"WALLS. Walls shall be defined as follows:

Load-Bearing wall. A wall supporting any vertical load in addition to its own weight.

Nonbearing wall. A wall which does not support vertical loads other than its own weight."

However... the State of Oregon's Building Codes Division issued the following Interpretation in 2014: Interp-14-03-retainingwalls.pdf

"Retaining walls. Statewide, retaining walls that provide safeguards for the users of the buildings, support a regulated building or retain material that, if not restrained, could impact a regulated building shall require a building permit. A municipality may adopt an ordinance to regulate other retaining walls, provided that the threshold established for requiring a permit does not include retaining walls 4 feet (1219 mm) or less in height, when measured from the bottom of the footing to the top of the wall except where the retaining wall supports ascending slope exceeding 3:1 or where the retaining wall supports a non-soil surcharge. A local height threshold greater than 4 feet (1219 mm) is allowed."
