Definitions That are Different

This may not match what you have in your state:

ACCESSORY STRUCTURE. A structure that is accessory to and incidental to that of a building or dwelling(s) and that is located on the same lot.

[A] LOT. A portion or parcel of land considered as a unit.
 
Hmmm ...

Our definition of accessory structure is the same, but our definition of lot is different.

[RB] LOT. A measured portion or parcel of land considered
as a unit having fixed boundaries.

And reading the definition of "accessory structure," the editor in me notices that it is grammatically incorrect. The second "that" ("incidental to that of") is indefinite -- it doesn't have any precedent so it's unclear what "that" is. The sentence should probably read, "A structure that whose use is accessory to and incidental to that of a building or dwelling(s) and that is located on the same lot."

Same exact definitions here (NY). I added my local definitions as an fyi.

Accessory structure:
A structure, the use of which is incidental to that of a residential building and which is located on the same premises. (Housing & Property Maintenance chapter)

A structure or building that is used incidentally to the principal use of a building or lot. Swimming pools, garages, carports, tool sheds, carriage houses, and pool houses are deemed accessory structures or buildings restricted to residential use. (Zoning chapter)

Lot:
A parcel of land, not divided by streets, devoted or to be devoted to a particular use, or occupied or to be occupied by a building or buildings, together with such open spaces as are required under the provisions of this chapter, and having its principal frontage on a street, as defined in this chapter.
