The Rapid City Council acknowledged the settlement agreement signed by the U.S. Department of Justice in which the City of Rapid City agrees to make improvements to the Rushmore Plaza Civic Center so it complies with the Americans with Disabilities Act. City officials received the signed agreement on Monday.
In it, Rapid City agrees to fix several architectural accessibility issues to make the facility – in its entirety – "readily accessible to and usable by individuals with disabilities".
The City also agrees to have the required number of designated accessible parking spaces, including van–accessible spaces, available on the grounds outside the Civic Center.
At Monday night's council meeting, Alderman Ron Weifenbach expressed regret for his vote in favor of the settlement last year, saying the updates are not a mandate by the Justice Department, that council members made their decisions with limited knowledge and that now the city is bound to a timeframe to get the upgrades done.
But Alderwoman Darla Drew pointed to concerns she heard recently over the lack of railings in the Barnett Arena and said the city is lucky it hasn't faced legal problems before.
The settlement says failing to comply in a timely manner would mean the City of Rapid City is in violation of the agreement.
The agreement is in effect for three years.
