Elevator exemption in CA

2010 California Building Code governs.

1102B Definitions

SHOPPING CENTER ... is one or more sales or rental establishments or stores. ...

1103B.1 EXEMPTIONS FROM ELEVATOR REQUIREMENT

2. The following types of privately funded multistory buildings do not require a ramp or elevator above and below the first floor:

2.1. Multistoried office buildings ... less than three stories high or less than 3,000 square feet (279 m2) per story.

2.2. Any other privately funded multistoried building that is not a shopping center ... and that is less than three stories high or less than 3,000 square feet (279 m2) per story ...

The project is a market, M occupancy with a mezzanine or 2nd floor +/- 1000 Sq. Ft accommodating only offices. Would the elevator exemption under 2.1 apply because the use of the second floor/mezzanine is limited to offices; or would the elevator exemption not apply, because the building is a "shopping center" as defined by 1102B?
