EMT to FMC on Remodel

Hmmm, I wonder what happened here. Looks like they moved the range box and instead of bending the EMT that was being used as an ECG, they added some FMC and they decided to use the new #12awg from the MC cable to ground the box for this 50A circuit. This is a NO NO since they are using FMC.
Trivia:
What code section(s) would be cited for the undersized ground?
