Esisting cab footprint less than ADA minimum.

Can a building official make you reframe an existing elevator shaft (70's era) to meet the minimum footprint ADA requires or can it be considered not doable as it would require restructuring the building.

Cab lacks turnaround space but you can backin (30 x 48") available with room to spare.
 
Very few building officials are authorized to enforce the ADA, most enforce the Building Code and the ICC/ANSI A117.1 standard.

The Existing Building Code would be the appropriate document for many (most?) jurisdictions, and within that document the amount of work being done to the building will require more (or less) to be done for Accessibility upgrades.

So, in order to better answer your question...

Where is the project?

What year edition of the Codes are in effect?

What local modifications have been made?

Has the IEBC been adopted?

What is the occupancy of the upper floors?

As a reminder to everyone you do not have to adopt the IEBC for a designer to use it

3401.6 Alternative compliance.

Work performed in accordance with the International Existing Building Code shall be deemed to comply with the provisions of this chapter.

This has been in the IBC since the 2009 edition. It is not the AHJ's choice, it is the designers choice to use it and the AHJ shall accept it.

Unless they are using the 2015 IBC as a base document. Chapter 34 is now 'reserved' and no longer has the existing buildings chapter.
 
1. 3 story, 2 above street level, 1 story lower than street level but exposed on 3 sides.

2. 2013 CBC & Santa Monica

3. Office building undergoing renovation: remodeled restrooms, new windows, T.I/20,000 sq. ft/ flr.

4. FD says ok to existing cab being less than gurney size.

5. S.E. says elev. shaft penetration can't be enlarged without impacting major elements of building structure.

6. Site work: some grading and restriping of parking lot (surface parking)

7. Cab controls and interior finishes upgraded.
 
But what if it requires major restructuring of the building, this is an interior shaft/tower surrounded by a stairs on 3 sides.
 
202.4 path of travel, bldg. built prior to 1994 (1973) with an elevator which was compliant per the code of the day. CBC has not required upgrades to existing buildings only that new work performed comply with current code. Does this imply having to add a new conforming elevator and restructuring the building?
