Exterior exit passageways

Question for (Canadian) folks.

Exterior exit passageways, such as seen on a typical hotel: say five second-storey units, served by a covered but otherwise open-air walkway with open-air stairs at both ends.

9.9.4.2(5) exempts open-air exterior exit passageways from the fire-rated protection required for exits;

However, 9.10.8.8. says that except for some light D/E occupancies and houses, exterior exit passageways have to be fire-rated or be n/c.

I view 9.10.8.8. as prevailing, since 9.9.4.2 deals with exits only.

How do you folks deal with this?

They are two different concepts.
9.9.4.2(5) is about exterior passageway separated from other floor area, that is , does the exterior wall separating the exterior passageway from other floor area need to be a fire separation with fire resistance rating?
9.10.8.8 is about the fire resistance rating of the exterior passageway floor itself, that is, does the floor of the exterior passageway need a fire resistance rating?
