Flue in exterior wall

Residential dwelling...How do you like this application?... Typically the mechanical guy will run the flue thru an interior closet and itll get framed around. This contractor decided to run it thru an exterior wall, cut out 90% of the top plate, squirted non heat rated spray foam right up against the flue pipe and called it good. They were able to maintain a 1" clearance around the pipe though...How many issues do you see with this?

What is the pipe listed for? (clearance) Strapping across destroyed plate, nailplating maybe, proper fireblocking, looks like that wall is padded...pay special attention there, see alot of guys missing that fireblocking...Did they get the termination height above the roof right?
 
Is that pipe furnace pipe?

Should be a label on the pipe or be stamped with 1" clearance to combustables, and every thing steveray sez!

Its the water heater flue. It has to be removed and top plate repaired and insulation installed in the exetrior wall.
 
If that is a water heater it should be a "b-vent." That looks like single wall pipe to me. Also need some fhk straps, an insulation shield and a c-note. Maybe 2 c-notes. Seriously though, is that dryer vent pipe? It sure doesn't look like a b-vent. Now if it is a tankless water heater it may be OK. They have zero clearance for some manufacturers.
