R308.4 Hazardous locations.

Glazing in enclosures for or walls facing hot tubs, whirlpools, saunas, steam rooms, bathtubs and showers where the bottom exposed edge of the glazing is less than 60 inches (1524 mm) measured vertically above any standing or walking surface.

Exception: Glazing that is more than 60 inches (1524 mm), measured horizontally and in a straight line, from the waters edge of a hot tub, whirlpool or bathtub.

The way this reads, a window in a wall that is opposing a bathtub, whirlpool, or hot tub shall be safety glazing if it less than 5' from the waters edge and less than 60" above the floor. Windows in a wall that opposes a sauna or shower shall be safety glazing without exception.

The code reads: "Glazing in enclosures for or walls facing...." Facing is synonymous with opposing.

This is one of those rarely enforced provisions, at least in this area. Many windows next to tubs are less than 5' off the floor and within 5' of the tub and untempered.
