Hazardous window location

32"x72" double pane fixed window, tempered glass within 6" of a deck surface where you would walk or Jr rides his trike. Same set up at grade below the deck.

Because it's tempered glass is not considered a hazardous condition and allowed by code?
 
The glass must be Category II safety glazing materials for it to comply. If the glass complies with Category II then it would not be considered hazardous.
 
when glass is marked with the bug in one of the corners that means it is tempered and therefore meets the catagory 2 designation.
 
I would say that the location described is a hazardous location which is why safety glazing is required. IMHO the safety glazing just makes it a "less" hazardous location.
