IRC spiral stair guards

Im trying to determine if the 4" sphere rule applies to infill under a handrail on an IRC spiral stair handrail. I think it does but find do many examples where it obviously does not.

The infill on stairs within the IRC since 2003 is 4-3/8".

Spiral or straight or winders, they are all the same as that requirement is i the guard section.
 
2018 IRC
R312.1.3 Opening limitations. Required guards shall not
have openings from the walking surface to the required
guard height that allow passage of a sphere 4 inches (102
mm) in diameter.
Exceptions:
1. The triangular openings at the open side of stair,
formed by the riser, tread and bottom rail of a
guard, shall not allow passage of a sphere 6
inches (153 mm) in diameter.
2. Guards on the open side of stairs shall not have
openings that allow passage of a sphere 43/8
inches (111 mm) in diameter.
