is this still a U465 one hour fire rated wall???

contractor added furring strips over the 3-5/8 in. deep (min) studs....is this still a U465 wall because it's beyond the min. width per the "fineprint" in the UL directory?

U465: the alternates allow 2-3/8" x 7/8" 25 MSG furring channels.

Studs must be 3-5/8 minimum, not maximum.
