It is not often you find a disconnect like this

For starters, I would say, 'You can't switch a neutral.' 404.2(B)
Schucks, in this case it is permissible. Exception to 404.2(B)

Next I would go with, 'You can't put an overcurrent device in the neutral.' 240.22
That one sticks.

What? You say that is not a neutral. 'Please reidentify.' 200.7(C)

Lastly, 'Your method of connecting the enclosure to the equipment grounding conductor does not meet the requirements of 250.8.'

Can't remark a white conductor in conduit as a ungrounded conductor,only in a cable assembly like cord as used on the line side (hope it's the line side, scary when it's not) of the switch, the ECG not bonded to the enclosure, when there is no neutral I bond the switch solid neutral & use it to land the EGC's, but that only works when the bonding screw is installed.
