At the summary judgment hearing this morning, Judge Mendez dismissed Johnson's case on the basis that the ADA claims were moot, and declined to assert jurisdiction over the Unruh Act claims. The judge even went so far as to state to plaintiff's counsel: "without the ADA claims, the state law claims are only about attorney's fees, aren't they?"

Case involving alledged non-compliant parking at a mini-market gas station.

Parking was provided, though in "technical" violation as to signage and a ramp descending into access aisle (legal at time of construction). Plaintiff removed all barriers based on my survey.

Owner was more than willing to cure, his failure was not doing due dilligence when he purchased the store.

As to fees, maybe he can recover his legal costs to defend himself?
