Kitchen Exhaust Fan Clearance to Walkways

We're planning a snack shack building (600sf) - first floorwill be the kitchen. The seating will be on an open roof deck directly above (flat roof). There will be a hood and the kitchen exhaust duct will go to a KE fan on the roof deck. Code requires 10' ht. from a walkway. Does the roof deck seating count as a walkway? Apart from smell issues, I'm just trying to clarify the code requirement for the height of this fan. Thanks in advance.
 
So you do not mind the customers setting next to the exhaust fan??

Will look at the book Monday

Maybe duct it as far away from the seating area as possible and throw up a short wall so you do not see it
