Lawsuit Filed Against City of Sherwood, Alleges Americans with Disabilities Act Violations

SHERWOOD, Ark. - A lawsuit was filed against the city of Sherwood on Tuesday that alleges multiple violations of the Americans with Disabilities Act, according to court records.
The lawsuit, filed on behalf of city resident Chris Jensen, states that Jensen visited a number of city premises and was denied "full, safe and equal access to the subject properties due to its lack of compliance with the ADA."
Jensen, the lawsuit states, has a spinal cord injury and requires a wheelchair for mobility. He said he encountered architectural barriers at multiple city locations that he attempted to visit.
"Title II of the ADA also requires a public entity to furnish appropriate auxiliary aids and services where necessary to afford an individual with a disability an equal opportunity to participate in, and enjoy the benefits of a service, program or activity conducted by a public entity," the lawsuit states.
The city of Sherwood failed to complete required structural changes to provide equal program access to individuals with disabilities, according to court documents.
Jensen claimed the following places he tried to visit violated the ADA:
Sherwood Animal Shelter
Delmont Park
Sherwood Recreational Center
Hensen Park & Tennis Center
Thornhill Park
Sherwood City Center (Hot Checks Department)
Don Hughes Park
Complaints at the above-named places include, no accessible parking, no accessible picnic tables, restroom entry doors are too narrow for a wheelchair user and more, the lawsuit states.
The lawsuit requests that a court declare the facilities to be in violation of the ADA, that a court order the city of Sherwood to alter its facilities, that a court award reasonable attorney's fees, costs and other expenses of the suit to Jensen, that the court award other relief as it deems necessary and more.
