Masonry Chimney

Applicant has an existing masonry fireplace and chimney in an existing single story house. The owners are proposing a second floor addition that will be built within 10’ of the existing chimney. The owners will be installing a gas fired insert within the existing fireplace opening. Would you require the chimney to be raised so that it meets the IRC, IBC code clearances for a masonry chimney? Or provide the clearances required by the Gas fired insert manufacturer which are less.
 
If the insert is removed would there be a violation? If that’s an affirmative I would ask for the most restrictive to eliminate that violation.
 
If its a true insert and not a regular gas fireplace they are "inserting" into the masonry one, they are typically listed to go into a code compliant masonry or factory wood fireplace. I took out the brand name, but this is from an install manual. Later in the book it gives their standard termination clearance requirements for all of their gas fireplaces... clear as mud.

_____________ gas inserts are designed for recessed installations into solid fuel masonry or factory built non-combustible fireplaces that have been installed in accordance with the National, Provincial, State and local building codes.

A new building permit would be required, and the code compliance evaluated at that point in time
 
After reflecting on this topic, I question why the insert wood stove changes the code requirement for the height of a chimney within 10' of a wall?
