I'm in the process of building a farmer's market (small prep kitchen but no stove/range, no Type I or II hood system, etc.) on my farm parcel in Michigan. My husband was my builder but has walked off the project out of spite as we'll be getting divorced after he became physical with me...so here I am trying to be learn as much as possible and keep the project on track.
We have a "farmstay / AirBnB" rental apartment upstairs for one family; up to four people. It has a separate entrance to outside and also a connected door to the storefront). Currently our EOR has placed it as a R-2 residential use upstairs and mixed use / Type V-B for the main floor. We have a two-hour fire wall/barrier creating separate occupancies.
The county has decided to require a 13R upstairs and no sprinkling downstairs.
Thanks to poor planning on several fronts, we've had to add an extension/close in one of the covered porch areas to accommodate the 2,500 gallon tank and fire pump area. We do not have municipal water.
My question was regarding 13D upstairs vs 13R for upstairs; which should it be? Our fire suppression contractor and our EOR both thought it should be 13D upstairs but the county is firm on 13R. From how I read the code it seems that they're separate buildings once a 2-hour firewall is included (we're doing two 5/8" drywall layers and RC resilient channel). I also read the "throughout the building" yet if they're separated...aren't they considered by the IBC separate buildings whether attached or detached?
-Is RC resilient channel required for the 2-hour fire assembly? Our EOR seems to think so yet all the other contractors said they've seen it used only for sound proofing? Our inspector at the county says it's not required yet our EOR is insisting it is required?
-Can you reference any code I can share with the county if it is supposed to be 13D?
