NM Cable Underground or In Conduit?

Caught working without a permit. Even if the plan was to pull the NM through the exterior UG conduit, that is a no no.

Reference: 334.12(B)(4) not permitted in a wet or damp location, 300.9 Raceways in Wet Locations Above Grade. Where raceways are installed in wet locations above grade, the interior of these raceways shall be considered to be a wet location. Insulated conductors and cables installed in raceways in wet locations above-grade shall comply with 310.8(C).
 
310.8 (C) appears to confirm this:

Wet Locations. Insulated conductors and cables used in wet locations shall comply with one of the following:
(1) Be moisture-impervious metal-sheathed.
(2) Be types MTW, RHW, yada yada yada.
(3) Be of a type listed for use in wet locations.
 
Can you point me towards an example of commercially available NMC cable that is not also listed as UF cable?

There is none manufactured that is straight NMC but some UF has a double listing UF/NMC.
Page 389 of UL White pages. Originally manufactured as "Barn Cable" until UF was produced.
Specifically listed in 547 Agricultural Buildings
