OH Door versus dock seals

A section of the energy code requires dock seals at all dock overhead doors. Has anyone found an exclusion or way around this?

Can you get out of calling it a loading dock or cargo door?...If it is not used for truck loading/ unloading I have allowed it without for "convenience" overhead doors for getting forklifts and other large items in and out of buildings....
 
I'm actually wondering why you want to get around this requirement. The price to install them on a single dock door is not outrageous and they certainly do help conserve energy while conducting loading/unloading operations. This requirement, unlike many in the energy code, actually makes sense and do help save energy.
