HB 2530 has been passed by the legislature and is on the Governor’s desk. This bill would allow an opt-in municipality to designate a JOINT or MULTI-MUNICIPAL board of appeals as its UCC Appeals Board, in lieu of having a board of appeals that serves its municipality only. This bill became necessary to address the concerns raised by a Commonwealth Court ruling earlier this year that disallowed joint boards of appeal for municipalities doing their own UCC administration and enforcement. Remember that under the Intergovernmental Cooperation Act, designating a joint or multi-municipal board of appeals must be accomplished by ORDINANCE, not by resolution.
