Panels in commercial bathroom

I have a change order that came in moving the location of sub-feeds from the main service putting them in an accessible, employee bathroom.

One is a 400A sub-feed from the outside service/disconnect and the other is a 225 sub from that one. They are side by side.

I do not consider these to be part of the service and are therefore allowed to be installed in the bathroom. It is a bathroom with a toilet and sink only.

One of my inspectors disagrees with me and thinks the definition of Service Equipment extends to sub-feeds

I would respectfully disagree with the view of the sub-panels being Service

Equipment...........From the `08 NEC, Article 100 - Definitions:

Service Equipment: The necessary equipment; usually consisting of a circuit

breaker(s) or switch(es) and fuse(s), and their accessories, connected to

the load end of service conductors to a building or other structure, or an

otherwise designated area, and intended to constitute the main control and

cutoff of the supply.

I think the inspector is incorrect also. Once you are past the service disconnect these are no longer service equipment

I wouldn't venture off too far down this road.
