Looks like they cut the ground rod so it doesn't hace the required full length.

Does it go through the bottom of the bucket to the building steel? Did they scrape off the yellow paint on the railing?

Is it required to be grounded ( RE: Article 250.34, 2008 NEC )?

I say no! Looks more like an egress escape route obstruction issue to me!
As far as the grounding, looks like a prank to me, not required per 250.34. But I don't know what OSHA would require?
