PVC roof drain/pipe coming down through a stair roof, and penetrating the stair's 2 hour fire wall?

It does give a list of what can be in the shaft,,,, Does not include rain down spout

1023.5 Penetrations

Penetrations into or through interior exit stairways and ramps are prohibited except for equipment and ductwork necessary for independent ventilation or pressurization, sprinkler piping, standpipes, electrical raceway for fire department communication systems and electrical raceway serving the interior exit stairway and ramp and terminating at a steel box not exceeding 16 square inches (0.010 m2). Such penetrations shall be protected in accordance with Section 714. There shall not be penetrations or communication openings, whether protected or not, between adjacent interior exit stairways and ramps.

As posted by CDA, 1023.5 does not permit a penetration related to a roof drain.

Can you re-pitch the roof? If not, put a horizontal assembly at the ceiling of the stairway and route b/w the roof and rated ceiling.

TyJ has the best solution....Although if it penetrated the unrated roof and unrated exterior wall, Shouldn't be a real problem, but code is code....New construction?

It might be able to be considered IF the drain only drains the roof immediately over the stair. Scuppers or gutters with exterior downspouts to the main roof would be a better solution.

It's a flat roof.

Could we change the pipe to steel, would that help?

Or, how about routing the pipe inside the 2hr stair wall? In that case, it would be a membrane penetration only.

Ryan S., ...can the pvc pipe be encapsulated
with custom made, fire rated materials ?
Construct "walls" made of Type X gyp. board,
...possibly two layers, completely sealed
around all areas of the pvc pipe ?

Have you discussed options with the local BO
or FCO ?
