Replacement Stairs for an Existing Building

Existing Car Dealership Building from 1965 with second floor greater than 3,000 sf

2009 IBC w/ 2012 IBC Chapter 11 & 2009 A117.1

There are two existing unenclosed stairs to the second floor; there is no elevator. We are proposing to remove one of the interior stairs that does not meet today's codes. A 60 sf canopy (above an exit discharge door) will be removed to allow a new 150 sf stair tower to be constructed on the outside of the building. Is the new stair tower an addition or an alteration?

There are some offices (internet sales, advertising, secretaries) proposed on the second floor that customers will not visit and most employees will not visit. Accessible restrooms are on the first floor. Is the second floor an area of primary function? Accessible accommodations could be made on the first floor if / when needed for employees in these offices.

The new stair tower will utilize the existing exit doorway (the door located beneath the 60 sf canopy) as access from the first floor to the stair tower. A new exit discharge door, direct to grade, will be added to the stair tower. Must the stairs be constructed as an accessible means of egress? Must the exit discharge door be accessible? Must the doors to the first floor and second floor be made accessible?

Doesn't matter if an addition or alteration. Must spend at least 20% on an accessible route. 2009 IBC 3411.7

Also see 3411.8.4 Stairs in existing buildings. Must have an accessible route if stairs are moved.
 
As brief of a review as I can give....

1. I would say addition as it is "new" space or footprint. Complies as new typically....

2. The second floor does sound like an area of primary function.......PRIMARY FUNCTION. A primary function is a major activity for which the facility is intended. Areas that contain a primary function include, but are not limited to, the customer service lobby of a bank, the dining area of a cafeteria, the meeting rooms in a conference center, as well as offices

3. yes ...New, complies as new

4. yes.....New, complies as new

5. Maybe....Did you meet the 20% with the other alterations? If so, you are done...
