Hello all....

Working from the 2012 IBC.

Client has a 3 unit condominium building. Each unit will be individually owned as a single family residence (Not transient rentals). The configuration is such that they are not "townhouses". One unit on the top floor, two units on the lower floor. This is the only building on this tax parcel.

Classifying the building as an R2.

Reading the Chapter 11 (2012 IBC & Commentary), 1107.6.2 for accessibility provisions for R2, calling these “apartment houses”,

1107.6.2.1.1 requires type A units only when “more than 20 dwelling units or sleeping units”.

The code commentary confirms that the type A requirement would apply only to a building with more than 20.

1107.6.2.1.2 requires all units to be type B “where there are four or more dwelling units or sleeping units intended to be occupied as a residence in a single structure”.

Would it be correct to interpret this to mean that since we have only 3 units none of the units would need to be accessible, type A, or type B?
