603.1.11- Partitions dividing portions of stores, offices or similar places occupied by one tenant only and that do not establish a corridor serving an occupant load of 30 or more shall be permitted to be constructed of fire-retardant-treated wood, 1-hour fire-resistance-rated construction or of wood panels or similar light construction up to 6 feet (1829 mm) in height.

Read the last three items. "fire retardant wood, 1 hr........ OR ..........

isnt this 3 options as or statement?

1 .fire treated.....
2. 1 hour FRRC
3. OR wood panel up to 6'
?????????????????????????????????????????

code official is saying that it is 1 hour fire résistance rated construction that is built of fire retardant treated lumber OR wood panels or similiar...........

Can I build a partition that is a 1hr rated assembly that is not using fire retardant wood above 6'?

I know that the commentary seems to not support this but the use of the commas and the "or" seems confusing no????

Yes, I believe you can.

A 1 hr rated assembly can be achieved many different ways, and it can even contain some combustible material. Its listing will tell you how high it can go, 6 feet is easy I guess.
