Separation requirement from garage -residence

I've got an existing residential structure with a double car garage below the bedrooms in the basement with no drywall attached to the underside of the FJ's. Drywall however was installed on the separation wall between the garage and the residence. Using the IEBC under repairs if appears that 603 leads me to believe that drywall would be required?

How would you interpret this?
 
House is being flipped with new electrical wiring, new waterlines and some sub-floor replacement including some drywall replacement. The garage did not have drywall attached to the underside of the FJ's.

IEBC 603.1 Fire Protection, General. Repairs shall be done in a manner that maintains the level of fire protection provided.

So would you allow the existing garage ceiling to remain unprotected? That's what the contractor would like to do.
 
"maintains the level of fire protection provided."....Make sure they fireblock and play through....If they are not making it worse, they don't need to make it better....

[A] 101.4.2 Buildings previously occupied.

The legal occupancy of any building existing on the date of adoption of this code shall be permitted to continue without change, except as is specifically covered in this code, the International Fire Code, or the International Property Maintenance Code, or as is deemed necessary by the code official for the general safety and welfare of the occupants and the public.
