Type 1 hood

We will be installing a type 1 hood. My question is the building next door is right up against the one we working on and is taller with a couple windows can anyone explain code for this its a brick building.
 
It depends on how close it is to the adjacent building. Check the mechanical code. Section 506.3.13 in my OH version.
 
It might have been built before building codes were adopted, or under an early building code that didn't address windows in a wall above another building.

IBC 705.8.5&6 address windows in a wall above an adjacent building.
