Upgrade stairway?

Hello, we are remodeling a home in NH that has a non-conforming stairway from the 1st floor to 2nd floor and then attic. Does anyone know the threshold for triggering a new code compliant stairway to be installed (which would involve major layout and framing changes)? The stairway was planned to stay along with treads and risers, but much of the home will be gutted to the studs and subfloor. Any code reference would be appreciated! Thanks, Ryan
 
That question is best asked to the local AHJ.

That said, once you tear it apart, it usually has to go back meeting current code standards. Leave it be, and it is allowed to remain.
 
Yup, get a hold of the AHJ, if you were doing that much demo here, you would be building compliant stairs.

Logically if you are not required in a commercial building because of limited space and construction then why should you be required in a residence?
This would have to be reviewed for each project since the "construction" might be easily modified to accommodate a code compliant stair.

2018 IEBC
503.1 General.
Except as provided by Section 302.4, 302.5 or this section, alterations to any building or structure shall comply with the requirements of the International Building Code for new construction. Alterations shall be such that the existing building or structure is not less complying with the provisions of the International Building Code than the existing building or structure was prior to the alteration.

Exceptions:

1. An existing stairway shall not be required to comply with the requirements of Section 1011 of the International Building Code where the existing space and construction does not allow a reduction in pitch or slope.
 
If you are adding square footage, you are intensifying the use, therefore need to upgrade the stair. If no new square footage, see above.
