A St. John the Baptist Parish man is suing the owners of Westside Plaza North shopping center over claims his disability prevents him from accessing all of its goods and services.

Wayne Gilmore filed a complaint Sept. 3 in the New Orleans Division of the Eastern District of Louisiana against Lake Charles PC LP, alleging a violation of Title III of the Americans with Disabilities Act.

The complaint alleges that Gilmore, who is paralyzed from the waist down and requires a wheelchair for mobility, has experienced serious difficulty accessing goods and utilizing services at the Westside Plaza North, a large shopping plaza located at 50 Westbank Expressway in Gretna. The property is owned by the defendant is obligated to comply with the ADA.

The complaint alleges the defendant is in violation of the ADA and is discriminating against Gilmore, who encountered inaccessible curb ramps and sidewalk routes throughout the property, as well as inaccessible parking spaces designated for disabled use.

Gilmore seeks declaratory and injunctive relief, attorney fees, and court costs. He is represented by Georgianne Sims of Ku & Mussman PA in Miami Lakes, Fla.
