I used to see that very often here (before my inspector days) Builders either put four feet of rigid outside, or this inside. I seem to remember it being mainly in one or two municipalities.

Insulation needs to go all the way to the slab.......what's the r-value.....and how about flame / smoke on the plastic.
2009 IECC prescriptive, yes.

Is a ResCheck submitted and approved?

Is this done prior to 2009 IECC?
