NM Cable in Type IIB Construction

Codes only stated here 16 years ago and see a lot of NM wiring in existing buildings. If existing I can't make them change it. I see it a lot in a existing suspended ceilings a lot lying on the panels too. I tried once to make them replace the NM where they replaced the suspended ceiling and moved a few walls and heating returns where they were using the ceiling as a plume but got over ruled on it.

If existing but less than 16 years old (April 2004) then why not?
