Hi all! New to the forum, but have seen several older posts adjacent to this issue. Haven't quite found clarity and would appreciate any insight!
Dealing with an existing A-2 building, not sprinklered, single story, less than 5,000 SF fire area, less than 100 occupants. 2015 ICC codes apply. Owner would like to add on 2 story patio. The lower level would be covered by the deck above. The upper level would be covered by a roof structure. Assuming total fire area still remains under 5,000 SF and total occupant load remains under 100, does IBC 903.2.1.2, condition 3, dictate they would still be required to sprinkler?
903.2.1.2 Group A-2
3. The fire area is located on a floor other than a level of exit discharge serving such occupancies.
My interpretation is that the upper deck would be an A-2 fire area. The exit would be the stair down to the main level. The exist discharge would be once you've exited the main level patio (a different floor). But this seems very restrictive to require sprinkler for such a small area.
If the upper level of the deck were to be open to the sky and patrons used only umbrellas, would that eliminate the "fire area" being on a level other than the level of exit discharge? It would no longer be bounded by "horizontal assemblies".
