Access restroom from different floor?

I have a three story mixed use building, the second and third story have been storage for many years, the third floor is now being converted to a business/assembly space ... the only restroom is located on the second floor ... where in the building code does it describe how far you, and number of floors, you can travel to get to a rest room?
 
How much are they increasing the occupant load with that COO and what IEBC compliance method are they using? They might be adding a bathroom anyway...
 
Also, an occupancy change might trigger accessibility upgrades according to current code.

Does the building already have a certificate of occupancy for B and A classifications?
Does the building provide elevator access between the floors?
